What this tool is – and what it is not

What the check is for

The AI content disclosure check is meant to help you find your way around Article 50 of Regulation (EU) 2024/1689. It covers the most common cases and names the underlying provision for every result, so that you can consult the relevant provision yourself.

What it is not for

• It covers Article 50 only, not the act as a whole. Prohibited practices under Article 5 and the requirements for high-risk systems are not included.
• It focuses on the information and disclosure obligations of deployers under Article 50(3) and (4). The technical provider obligations under paragraph 2 are not fully covered.
• It does not take other areas of law into account. Data protection, copyright, personality rights, media law and competition law may apply independently.
• It cannot resolve borderline cases. Whether content “could be mistaken for genuine” or whether a use is “professional” depends on circumstances that a questionnaire cannot capture.
• It does not replace review by a lawyer, particularly where significant financial consequences are at stake.

State of the law

The check reflects the position as at 2 August 2026. It draws on:

The Commission's guidelines are not legally binding. Binding interpretation of Union law remains a matter for the courts and ultimately for the Court of Justice of the European Union.

This is the English version of a tool originally written in German. Where the two versions differ in wording, the decision logic behind them is identical – it exists only once and is shared by both.
